Terms of Business for all orders placed with The Plastics and Engineering Company Ltd
The Plastics and Engineering Company Limited would like to operate a policy of “Reasonable Behaviour” towards all its customers and welcome communication and a mutual agreement towards a Purchasing/Sales Policy. If you have any query regarding the following or would like to renegotiate, please contact The Plastics and Engineering Company Limited.
Should the customer require any alternative terms, they must be agreed in writing prior to an order being placed, when placing an order you agree to accept our terms of business and no other terms will be placed upon The Plastics and Engineering Company Ltd by anyone or business when we are supplying goods or services.
All Invoices are due for payment 30 days after proof of delivery for the goods ordered unless you have agreed payment terms from the Plastics and Engineering Company Ltd.
All days after the payment due date will be charged statutory interest plus the Bank of England base rate per day if not paid and compensation for the time spent chasing the payment will be added accordingly. After 7 days from you receiving the late payment letter if we have both not agreed on a payment date, and we have still not received the payment we will be forced to pass the invoice onto a collection team to collect on our behalf and at an added cost to you. This will then affect any future credit we give you.
Any goods that are found to be faulty must be returned to us as within 30 days from receipt of delivery, all goods that are being returned must be returned in the same bags/packaging they were sent out in, the parts must not have been used or damaged by yourselves as this will be at our discretion to accept them back under these circumstances.
Any work or damage done by yourselves to your order once received from us we will not be able accept back, and you will still be liable for any outstanding payment for the goods, if there is damaged during delivery the courier needs to be informed immediately and then The Plastics and Engineering Compnay Ltd, this will enable us to resolve and replace any damaged goods, if this is not done and we are not informed we cannot accept responsibility later on, any rework that you require that is found not to be our fault will be charged for.
It will be up to the Plastics and Engineering Companies discretion to allow any orders that are found to be faulty after the 30 days period ends to be returned and the Plastics and Engineering Company Ltd will need to give you permission for this in writing, if you return the goods without us agreeing to accept them back in writing from a manager of The Plastics and Engineering Ltd, the goods/ parts will be disposed of and we may charge for this waste disposal service.
Credit will not automatically be given on any order found to be incorrect or you deem to be faulty until we have received and inspected the goods returned ourselves and agree there is a fault.
Goods/components found to be faulty after 30 days by you will not be credited unless agreed in writing by The Plastics and Engineering Company Ltd. If we agree to a credit or refund this can take up to 14 working days from receipt of goods returned to us and only when they have been accepted as retuned within our terms of business guidelines.
Any orders placed and then cancelled by you will be invoiced for anytime spent working on your order and the material cost or any other costs that we have incurred.
The Plastics and Engineering Company Ltd reserves the right to cancel any order that due to unforeseen circumstances or the material significantly exceeds the costs quoted and therefore becomes unprofitable for the company to manufacture. Quotes given expire after 7 days so we may not be able to keep the same price and a new quote will be needed.
If we are purchasing goods from one of our suppliers and they are not able to deliver the parts/goods needed to fulfil your order, this will be deemed as out of our reasonable control and the Plastics and Engineering Company Ltd will not be liable for any loss you incur because of this.
All goods remain the property of The Plastics and Engineering Company Limited until paid in full.
Delivery of Goods:
Unless otherwise agreed in writing by The Plastics and Engineering Company Ltd, the costs of packing, carriage and delivery of Goods will be paid by the Buyer.
b. The Goods will be delivered to the Buyer's address as stated on the Delivery Note. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
c. Any date for delivery specified by The Plastics and Engineering Company Ltd shall be treated as an estimate only and time shall not be of the essence.
d. The Plastics and Engineering Company Ltd shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods (even if caused by The Plastics and Engineering Companies negligence), nor shall any delay entitle the Buyer to terminate or rescind the Contract unless such a delay exceeds 90 days.
e. If the Buyer does not accept delivery of the Goods when delivered by The Plastics and Engineering Company Ltd, The Plastics and Engineering Company Ltd shall in its absolute discretion be entitled to treat the Contract as at an end, or to deliver the Goods on a later date and if the latter, the Buyer shall be liable to pay The Plastics and Engineering Company Ltd a reasonable sum of storage and to reimburse The Plastics and Engineering Company Ltd for any loss of time or money spent in trying to deliver the Goods. The Plastics and Engineering Company Ltd shall not be under any liability to the Buyer for any loss or damage to the Goods whilst in storage howsoever arising.
f. The Plastics and Engineering Company Ltd shall not be liable for any loss or damage or deterioration in the Goods from the time of the despatch of the Goods from the companies Premises from whatever cause. Goods shall be deemed to have been despatched in full quantity and in good condition unless particulars of shortage or defects alleged are notified in writing by the Buyer to The Plastics and Engineering Company Ltd within 5 days of the date of receipt as shown on the Delivery Note.
Returns
The Buyer is not entitled to return Goods on grounds that they are defective on receipt without first giving The Plastics and Engineering company Ltd written notice within 5 days of receipt of the Goods whereby The Plastics and Engineering Company Ltd will decide whether to accept returned Goods for analysis, repair, replacement or credit.
Where Goods supplied by The Plastics and Engineering Company Ltd have been supplied for clean room use or sterile packaging, these will not be accepted for return once used, even if the Goods prove to be defective. Instead the Goods must be disposed of by the Buyer.
The Buyer will have no claim against The plastics and Engineering company Ltd unless the Buyer notifies the company within 5 days of receipt of the Goods that there is a defect upon receipt.
All returns are subject to the Sellers acceptance and issuance of an Authorised Goods Return Number (GRN) and will be inspected upon return prior to further action. The Seller reserves the right to apply a returns handling charge where appropriate.
. Exclusions and Limitations:
a. The Plastics and Engineering Company Ltd shall be under no liability whatsoever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of the breach of this contract.
b. In the event of any breach of this contract by The Plastics and Engineering Company Ltd, the remedies of the Buyer shall be limited to damages and under no circumstances shall the liability of The Plastics and Engineering Company Ltd exceed the price of the Goods.
Cancellation: a. The Plastics and Engineering Company Ltd may cancel this Contract at any time before the Goods are dispatched by giving written notice. The Plastics and Engineering Company Ltd shall not be liable for any loss or damage.
Tools: a. Any tools which The Plastics and Engineering Company Ltd may construct or acquire specifically in connection with the Goods shall remain the Companies sole and unencumbered property and in The Plastics and Engineering companies possession and control without restriction.
Our terms of business will continue to evolve and may change at any point, this will not affect our main principles and standards but instead allows us to operate fairly and reasonably to provide a good standard of service to our customers.
